Суд тизими ва суд ҳокимиятининг мустақиллиги бир бирига боғлиқ бўлган тушунчалардир. Суд тизими шаклни, суд ҳокимиятининг мустақиллиги эса мазмунни ифодалайди. Бироқ, суд тизими суд ҳокимиятининг мустақиллигига путур етказмайдиган тарзда ташкил этилиши лозим. Мазкур мақолада Ўзбекистон ва Америка Қўшма Штатларида суд ҳокимияти органларининг тизими, судларнинг тузилиши, унинг суд ҳокимияти мустақиллигини таъминлашдаги аҳамиятига доир масалалар муоҳокама этилган. Ўзбекистонда суд ҳокимияти органларининг тизимига доир ҳуқуқий асосларни такомиллаштиришга доир таклифлар илгари сурилган.
