LEGAL AND INSTITUTIONAL FOUNDATIONS OF PLACEMENT FORMS FOR ORPHANS AND CHILDREN DEPRIVED OF PARENTAL CARE

This scientific article provides a comprehensive analysis of the system of alternative placement for orphans and children deprived of parental care, as well as the existing forms of its implementation. The study examines the regulatory legal acts governing this sphere, their content, and law enforcement practice, and reveals the significance of recent institutional and legislative reforms aimed at improving the child rights protection system in the Republic of Uzbekistan. The article presents a comparative analysis of alternative placement forms such as guardianship and trusteeship, foster care (patronage), and adoption in comparison with institutional care, substantiating the legal and social aspects of family-based placement in ensuring the best interests of the child. At the same time, it highlights that raising children in conditions as close as possible to a family environment is an important factor in their social adaptation and holistic development. In addition, the article analyzes the role of the “Inson” Social Services Centers as guardianship and trusteeship authorities, as well as the powers of the Social Inspection in protecting children’s rights, exercising control over compliance with legislation, and applying administrative penalties for administrative offenses, including the implementation of accountability mechanisms.
