ISSUES OF INTERNATIONAL LEGAL PERSONNESS OF TRANSNATIONAL CORPORATIONS IN THE DIGITAL AGE AND STRENGTHENING THE STATEHOOD

The article is devoted to the issues of strengthening the role of transnational corporations (TNCs) in the transition to a digital economy. The article notes that digitalization is the most important factor in the development of the international economy and the strengthening of the role of TNCs in the global economy. The article considers the concept that TNCs are limited subjects of international law, and presents facts confirming the strengthening of the role of TNCs in the international system, especially digital TNCs. The strengthening of the role and influence of digital TNCs leads to the formation of technocracy, that is, a new form of social management, which poses a threat to states, as it can weaken their role as subjects of international law. These trends are reflected in the post-positivist concept of sovereignty. The article also considers the concepts of transnational and global law, which are put forward as a replacement / alternative to international law due to the strengthening of technocracy.
