FORMS OF PREPARATION FOR CRIME

In this article, in accordance with article 25 of the Criminal Code of the Republic of Uzbekistan, based on the materials of judicial practice, an analysis of each of the forms of preparation for a criminally punishable act is carried out. Based on the concept of preparation for a crime expressed in the law, the author defines an act that creates conditions for the commission or concealment of a crime. Using examples of practice, it is analyzed that creating conditions for the commission of a crime means drawing up a plan of a crime, preparing, adapting, searching for tools of the means of crime, searching for accomplices in a crime, conspiring with them and other acts. The next part of the article explores what acts are classified as creating conditions for concealing a crime and concludes that they are understood as activities aimed at creating the possibility of avoiding criminal liability after the commission of a crime or hiding the person who committed the crime, and consisting in providing psychological or physical assistance to a participant in a crime in concealing a crime. In the final part of the article, relevant conclusions and recommendations are developed regarding the qualification of forms of preparation for a crime and its differentiation from completed crimes with a similar composition. Also, proposals are presented to reflect the concept of preparation for a crime in the new edition of the criminal law.
