LEGAL DOCTRINAL APPROACHES TO WAYS TO ENFORCE OBLIGATIONS

Abstract

The article analyzes issues related to civil-law enforcement of obligations, civil-law methods to ensure the fulfillment of obligations, the concepts of “functional”, “external source of fulfillment” and “subjective law”, new technologies such as “Smart” agreement (“Blockchain”), Amendments and additions to the Civil Code of national and foreign countries, the views of legal scholars on the definition of civil law methods to ensure the fulfillment of obligations, combining specific features into a single a system of civil law methods ensuring the fulfillment of obligations. In addition, with a new look, the concept of civil law methods to ensure the fulfillment of obligations is given.
