ACTUAL PROBLEMS OF LEGAL REGULATION SPORTS CONTRACT

Abstract

The article considers the legal aspects of labor relations in sports, examines the legal nature of sports contracts, as well as the issues of improving the norms governing relations related to sports contracts. The issue of registration of relations between the employer and the athlete, coach is widely discussed in foreign legal science. In the light of the latest legal acts adopted in our country in the field of physical culture and sports, it is becoming more and more relevant for Uzbekistan. The question of the nature of the contract that forms this type of relationship remains debatable: should it be considered an employment contract, a civil contract, or a new type of contract-a sports contract (mixed) with elements of the first two? It is also important from a legal point of view to determine the legal nature of a sports contract. The specific duties of the athlete in accordance with the contract are considered and analyzed. For example, such specific duties as the duty to play professionally in a certain sport only for a certain team, the duty to play at full strength, maintain their physical and psychological condition at the proper level, persistently and persistently improve their sports skills, etc. The issues of transfer, or transfers of athletes from one sports organization to another, were also the subject of research. The transfer is considered as a temporary transfer of the athlete to another employer to continue playing professional sports. The employment contract concluded with the former employer is suspended and resumed at the end of the period of temporary transfer of the athlete. This is an innovation for the labor law of Uzbekistan, and, as a result, some issues have not yet been resolved. The provisions on the restriction of the athlete's personal rights were considered from the perspective of foreign and national legislation. Based on the analysis of foreign experience and national legislation, proposals and recommendations for amendments and additions to the legislation of the Republic of Uzbekistan regulating relations on the conclusion and execution of a sports contract are given.
