PROCEDURAL FOUNDATIONS AND FEATURES OF THE USE OF REHABILITATION AT THE PRE-TRIAL STAGES

The article explores some matters in the field of the citizen protection from illegal criminal prosecution and accusation, restriction of their rights and freedoms. Also examined a mechanism of compensation for harm caused by unlawful or unjustified criminal charges. The conclusion is formulated that the legal nature and the legal consequences of procedural actions provide the right to rehabilitation are significantly different, and in itself the consideration of the case in court, the creation and development of events. It was concluded that the legal nature of the procedural documents granting the right to rehabilitation and the significant legal consequences for the person, the fact that the case is considered in court will create more opportunities for the person to prove his innocence, to be fully rehabilitated by acquittal.Proposals for improving legislation are justified.
