PROBLEMS OF IMPROVING CRIMINAL LIABILITY FOR VIOLATION OF ROAD TRAFFIC AND VEHICLE OPERATION RULES

This scientific article provides a comprehensive analysis of issues related to criminal liability for causing death and bodily injuries as a result of road traffic accidents. Based on statistical data, the study evaluates the regulatory legal acts of the Republic of Uzbekistan aimed at ensuring road safety, as well as the institutional and technological reforms implemented in recent years. Particular attention is paid to a critical examination of proposals to mitigate liability envisaged in the draft law amending Article 266 of the Criminal Code, from the standpoint of the principles of criminal law and legal justice. In addition, using a comparative legal method, the article examines approaches to determining forms of guilt in road traffic accidents within the legal systems of European countries, the United States, and Islamic law. The findings substantiate the necessity of maintaining criminal liability and ensuring the inevitability of punishment for road traffic accidents resulting in moderate and serious bodily harm.
