ИСКУССТВЕННЫЙ ИНТЕЛЛЕКТ И БУДУЩЕЕ УГОЛОВНОЙ ОТВЕТСТВЕННОСТИ: СРАВНИТЕЛЬНО-ПРАВОВОЙ АНАЛИЗ

Настоящая статья посвящена проблемам уголовной ответственности, возникающим в связи с ускоренным развитием технологий искусственного интеллекта (ИИ). В ней анализируются теоретические основы установления ответственности за правонарушения, совершённые с помощью систем ИИ или с их использованием, с особым акцентом на применение доктрин mens rea и actus reus в контексте ИИ. Проводится сравнительный анализ правовых систем Соединённых Штатов Америки, Европейского Союза, Китая, Германии и других ведущих юрисдикций. В статье также рассматриваются актуальные проблемы, включая мошенничество с применением технологии «дипфейк», летальные автономные системы вооружения и финансовые преступления, совершаемые с использованием ИИ. По итогам исследования делается вывод о недостаточности действующих законодательных механизмов и обосновывается необходимость целенаправленных правовых реформ, в том числе принятия специальных норм об уголовной ответственности в сфере ИИ, введения стандартов строгой ответственности и расширения международного сотрудничества.
