ONLAYN SAVDO PLATFORMALARI OPERATORLARINING HUQUQIY MAQOMINI BELGILASH: DOKTRINAL YONDASHUVLARNING QIYOSIY-HUQUQIY TAHLILI

Maqolada onlayn savdo platformalari operatorlarining huquqiy maqomini aniqlashga doir asosiy ilmiy yondashuvlar tahlil qilinadi. Huquqiy doktrinada uchta asosiy model ajratiladi: vositachilik modeli, operatorlik modeli hamda gibrid model. Vositachilik yondashuvi platformani shartnoma mazmunida bevosita ishtirok etmaydigan texnik vosita sifatida talqin etadi. Operatorlik modeli esa javobgarlikni platformaning bitim shartlari va ularning bajarilishi ustidan amalga oshiradigan nazorat darajasi bilan bog‘laydi. Gibrid model savdo platformasining raqamli huquqiy munosabatlarning mustaqil subyekti sifatidagi tashkiliy va tartibga soluvchi rolini ta’kidlaydi. Xorijiy va o‘zbek ilmiy manbalarining qiyosiy tahlili shuni ko‘rsatadiki, “vositachi” va “sotuvchi” o‘rtasidagi an’anaviy ajratish zamonaviy platformalarning murakkab huquqiy tabiatini to‘liq aks ettirmaydi. Maqolada platformaning nazorat darajasi hamda raqamli bitimlarda xavflarning taqsimlanishini hisobga oluvchi funksional yondashuv zarurligi asoslab beriladi.
